Product liability

The Cologne office is one of the most renowned addresses for manager and product liability. The team around Lenz and Laschet, clearly positioned on the side of insurers, stands for the handling of major claims and consulting on product safety including recalls - currently in connection with e-cars, for a kitchen furniture manufacturer and a German household appliance manufacturer due to chemicals in the USA and Canada. The know-how of the partners was particularly valuable during the Corona crisis, for example when they took an oath in the spring regarding business interruption insurance or when medical products such as masks and protective visors were introduced. In order to broaden the commitment, it would be advisable to intensify the already visible cooperation with the Freiburg office, which is known for corporate law disputes.

Strengths: Experience with major claims; advice on D&O coverage and liability.

Often recommended: Tobias Lenz ("pragmatic negotiator", competitor), Carsten Laschet ("competent, objective, good", client; mainly product liability)

Team: 2 Partners, 1 Counsel, 4 Associates

Focal points: Recalls and settlement of major claims, also internationally. Regular advice to insurers. In addition, distribution law and project-related disputes. Disputes under stock corporation law, especially in Freiburg.

Clients: Allianz regularly in D&O claims; AIG regularly on product liability and coverage law, among others in connection with Cologne City Archives; former listed agricultural company in appraisal rights proceedings after cross-border merger; Endress+Hauser in appraisal rights proceedings against shareholders of Analytik Jena due to squeeze-out; kitchen furniture manufacturer on recall and recourse proceedings; household appliance manufacturer on prevention of recall due to chemicals; D&O insurer in connection with insolvency of a German kitchen manufacturer.

Insurance law

The Cologne insurance practice continues to be very much in demand, particularly in the areas of manager and product liability. Many mandates come about through the close relations of Lenz and Laschet in the insurance industry. The firm's clients include a large number of well-known D&O insurers whom it advises on complex claims. The close cooperation with our corporate and insolvency law practices regularly pays off. When it comes to product liability, the team often operates in a cross-border context, for example, when advising a household appliance manufacturer on the avoidance of a chemical recall in the USA and Canada. Here the firm benefits from its well-functioning best-friends network. The practice is also in demand in the corona area, for example, when advising an international medical company on insurance law regarding certifications, e.g. of face and respiratory protection masks. Accompanying a trading company after a hacker attack shows that last year's establishment of the Cyberrisk team, which operates at the interface to data protection, is bearing its first fruits and can be expanded.

Strengths: Long-standing cooperation of the team, especially in D&O and product liability cases.

Often recommended: Carsten Laschet ("competent and objective", client), Tobias Lenz ("specialist for D&O and liability cases, good man for product liability issues", competitor), Mike Weitzel

Team: 2 equity partners, 1 salary partner, 4 associates

Focal points: Disputes and litigation, especially D&O insurance, manager liability, increasingly related to insolvency. Besides recourses. Specialization in environmental liability. Also active in product liability (trade and liability) for insurers and manufacturers.

The practice around the Cologne partners Lenz and Laschet is a renowned address for product liability cases and D&O disputes. Backbone of the business are excellent contacts in the insurance industry. For the often complex claims, the team regularly uses interfaces to practices such as corporate, insolvency and construction law. Clients praise among other things the "deep technical understanding" in product liability cases. Further emphasis is to be placed on a recently formed team around Lenz and an associate, which bundles know-how on the subject of cyber risks - the practice is particularly experienced in dealing with so-called fake-president cases, including working alongside an insurer in the major Leoni case, which has attracted attention throughout the industry. Product liability

Friedrich Graf von Westphalen & Partner covers the spectrum of product liability, from preventive advice to the taking of measures in the event of product defects. The team is particularly experienced in product recalls, often with an international dimension, and benefits from the firm's insurance law focus. Carsten Laschet and Tobias Lenz are highlighted.

Insurance Law

The support of D&O and manager liability proceedings forms the core of Friedrich Graf von Westphalen & Partner's practice, which is characterized by "very fast, precise and practice-oriented processing", as well as "high commitment" and a "coherent price-performance ratio". The eight-member team is led jointly by Tobias Lenz and Carsten Laschet and counts well-known German and international insurers among its clients.

JUVE Handbook Commercial Law Firms 2018/2019

Insurance litigation

The Cologne insurance practice with its focus on manager and product liability is clearly on the side of the insurers. Structurally, it is therefore most comparable to units such as Thümmel Schütze; both firms have few industrial clients, which in other firms with strong insurance law practice have internal conflict potential. The main business is the work as Monitoring Counsel, where Lenz accompanies an insurer in connection with one of the largest fake-president cases. Further important pillars are the handling of major claims and worldwide recalls, which Laschet stands for. In addition, the product-related consulting of insurers is also gaining in importance: The fact that this currently involves D&O policies relating to persons instead of companies shows that the team, which was recently expanded to the associate level, is closely oriented to the latest market developments.

Strengths: Long-standing cooperation of the team, especially in D&O and product liability cases

Often recommended: Tobias Lenz ("approaches cases pragmatically", "good technical understanding", client; "skillful negotiator", competitor), Carsten Laschet ("very pragmatic", client on both), Mike Weitzel ("very good in court", client)

Priorities: Disputes and litigation, especially D&O insurance, manager liability, increasingly related to insolvency. Besides recourses. Specialization in environmental liability. Also active in product liability (trade and liability) for insurers and manufacturers

Clients: Allianz regularly in D&O claims; Bundesgesellschaft für Endlagerung liability and insurance law; Zurich in liability and coverage law dispute between Ford and supplier; AIG regularly in product liability and coverage law, i.a. in connection with the Cologne City Archive; insurer in connection with the fake-president case at Leoni (known in the market); Swiss insurer in connection with gas storage leaks; insurer on irregularities in the sale of marine Diesel engines; D&O insurer on damages due to insolvency of German kitchen manufacturer

Product liability

The Cologne practice with its focus on manager and product liability is clearly positioned on the side of insurers and regularly wins mandates through contacts in the industry. The fact that the firm has fewer large industrial clients than many of its competitors has proven to be an advantage - because these clients often harbor conflict potential in other firms with strong insurance law practices. Important pillars of the business are the handling of major claims and worldwide recalls, which Laschet stands for, and D&O complexes. Lenz is involved in the handling of one of the largest known fake-president cases in the market for an insurer. In the future, a law firm like FGvW offers opportunities to expand the litigation business beyond niches such as insurance and sales-related mandates.  The first antitrust damages cases on the plaintiff side show what is possible. Compliance-related mandates, such as the recent D&O case in industry, are also promising.

Practice strengths: Experience with major claims; advice on D&O coverage and liability

Often recommended: Tobias Lenz ("quick perception, technically intelligent, proactive", client), Carsten Laschet ("very pragmatic", client; "good strategist", competitor; especially product liability)

Priorities: Recalls and settlement of major claims, also internationally. Regular advice to insurers. In addition, distribution law disputes and project-related disputes, arbitration proceedings.

Clients: Allianz regularly in D&O claims; Federal Company for Final Disposal on liability and insurance law issues; Zurich in liability and coverage law dispute between Ford and suppliers; AIG and others. in connection with the Cologne City Archive; Fiat Dealers' Association in ongoing litigation; insurer in connection with the fake residence case at Leoni (known in the market); D&O insurer on losses due to the insolvency of German kitchen manufacturer; pump manufacturer in asserting claims for damages against truck cartel

JUVE Handbook of German Commercial Law Firms 2017/2018

Commercial Litigation and Liability

This litigation practice is respected first and foremost for its work in connection with product liability and D&O. It did a good job of standing the loss of a renowned partner, who left FGvW to set up his own firm. Instructions tend to emerge via Lenz and Laschet’s close ties to the insurance sector. The firm recently managed to strengthen its relationship with Zurich, for instance, when Lenz helped the insurer settle a dispute between Ford and a supplier arising from US arbitration proceedings. The practice was also extremely present in liability matters associated with the final disposal of atomic waste. FGvW asserted itself in a tender here and is advising a specially formed, federally owned company on liability and insurance matters (…).

Strengths: Many years of experience in major claims; advice on D&O coverage and liability.

Recommended: Prof. Dr. Tobias Lenz (“extremely prudent, very easy to work with”, client), Carsten Laschet (“strategically skilled”, competitor; esp. product liability).

Practice: In product liability, focus on (international) recalls. Regular advice to insurers. Also distribution disputes and project-related disputes, also arbitration. (2 partners, 6 associates)

Clients: Federal company for radioactive waste disposal (BGE) on liability and insurance law; Zurich in dispute concerning liability and insurance coverage between Ford and supplier; regular advice to AIG on product liability and insurance coverage, also in connection with the Cologne city archive; supplier in connection with complaint proceedings concerning truck recall by Mercedes-Benz Actros (regional court); Swiss insurer on insurance coverage in connection with gas storage leaks.

Insurance Litigation

This recommended firm in insurance is renowned for D&O claims and product structuring and has coped well with the departures it experienced over the past year. The associate level is now growing again. Instructions come mostly from the close contacts of Lenz and Laschet in the insurance industry. The firm recently deepened its relationship to the insurer Zurich, which Lenz is advising on the settlement of a dispute between Ford and a supplier through US arbitration proceedings. The practice also appeared prominently in connection with liability questions related to the final disposal of nuclear waste. Here, FGvW won a tender and now advises a specially founded governmental company on liability and insurance law. The team is also sought after in product development: it advised multiple insurers in connection with a type of D&O insurance that offers individual policies rather than the customary company policies.

Strengths:Long-standing teamwork, esp. in D&O and product liability claims.

Recommended: Prof. Dr. Tobias Lenz (“many years of very good work together”, client; “pleasant and highly professional”, competitor; primarily D&O liability), Carsten Laschet (esp. product liability).

Practice:Focus on disputes and litigation, esp. D&O insurance and managerial liability, increasingly related to insolvency. Also recourse cases. Specialty in environmental liability. Product liability (commercial litigation and liability) for insurers and manufacturers. Advice to Mittelstand companies on risk issues. (3 partners, 4 associates)

Clients:German governmental company for the final disposal of nuclear waste on liability and insurance issues; regular advice to Allianz on D&O damages claims; Zurich in liability and coverage dispute between Ford and supplier; regular advice to AIG on product liability and coverage issues, incl. in connection with the Cologne city archive.

This firm recommended in insurance is still a renowned team for D&O claims and product liability. The work of one counsel who joined the firm from Hogan Lovells last year has developed positively. Together with Laschet, for example, he is representing a plant construction company against an energy utility in a dispute over a power plant project. Cooperation between the plant construction practice, product liability and insurance law has, however, been an exception up to now.

Strengths: Long-time cooperation of the team, primarily in D&O and product liability claims. Many years of experience in major claims; advice on D&O coverage and liability.

Recommended: Prof. Dr. Tobias Lenz (“very rational, easy to work with”, client; “extremely experienced”, competitor), Carsten Laschet (“good strategist”, competitor; primarily product liability).

Practice: Focus on disputes and litigation, esp. D&O insurance policies, managerial liability, increasingly with an insolvency aspect. In addition, recourse cases. The Legal 500 Germany 2015

Friedrich Graf von Westphalen & Partner has a „strong market position“ in its specialized area manager liability and D&O insurance. The Cologne team led by Tobias Lenz, who has a “good reputation” and Carsten Laschet also covers the area of product liability insurance, including recall insurance, as well as environmental liability and property and fire insurance. The firm combines corporate law, criminal law and insurance law competences, as well as the continuously growing compliance sector with a nationally and internationally active process practice. The advice of a leading industrial insurance company with regard to cases of D&O liability on the grounds of delayed filing of insolvency with a dispute sum of several million euros was certainly a highlight. The firm also regularly advises AIG, Allianz and ACE Europe in connection with cases of D&O liability. FGvW was also mandated by a German insurance company in connection with a product liability case of a tar paper producer in France, with a dispute sum of €17 million, and is also mandated by a well-known manufacturer of electronic devices with regard to a worldwide case of recall of kitchenware.

JUVE Handbook of German Commercial Law Firms 2015/2016

The firm has nationwide renowned experts for manager liability and cross-border product liability cases. In this practice area the firm continuously advises AIG with regard to insurance coverage issues, as well as the large chemicals dealer Brenntag with regard to an international case of fraud concerning inferior quality silicone. Unlike in other growing practices such as BLD and CMS, these top mandates did not lead to further investments in personnel at FGvW.

The much valued litigation practice belongs to the most renowned D&O and product liability teams in Germany. FGvW was involved in several of the largest manager liability cases during the financial crisis. Since these cases are largely regulated, new management liability claims arose after the insolvencies. In these cases the Cologne team of Tobias Lenz often relies on its own restructuring practice. In the field of product liability, the automobile sector, medical devices and environmental damages are responsible for the continuously high workload of the partners.

Strenghts: Longstanding experience with major claims; advice with regard to D&O coverage and liability. Long-lasting cooperation of the team, especially with regard to D&O and product liability cases.
