Comprehensive Reform of Procurement Law, Procurement Law Training Sessions

After publication in the Federal Law Gazette it is now official: as of 18 April 2016, numerous new regulations will become effective in procurement law. The basis are European guidelines which shall be implemented into German law by 18 April 2016. Due to the comprehensive nature of the new regulations, they may rightly be called the "largest procurement law reform of all times."

The objects of the reform are

  • the introduction of completely electronic procurement,
  • the creation of legal regulations for so-called in-house procurement,
  • the introduction of new statutory regulations (e.g. special regulations for awarding construction or service concessions),
  • the expiration of "notorious" regulations, such as the VOL/A-EG and the VOF,
  • the fundamental new regulation of procurement across Europe in the areas of services / deliveries, and architect services in the procurement statutes,
  • the shortening of deadlines in procurement processes,
  • the introduction of the so-called Uniform European Self-Declaration (comprehensive document as the basis for reviewing the suitability of a bidder),
  • the introduction of a new process type: innovation partnership,
  • the creation of statutory regulations for modifying a contract without a bidding process,
  • the establishment of a complaint period,
  • etc.

The introduction of electronic bidding processes, in particular, will present many challenges to both awarding entities and bidders / applicants. Additionally, however, the new regulations are also accompanied by opportunities and risks associated with the creation of invitations to tender for all process participants, which must be avoided or utilized.

In response to the procurement law reform, we offer both overview training sessions and full-day training sessions. The goal of the overview training sessions is to offer users a simplified introduction to the new regulations. During the full-day training sessions, the overview will be deepened using practical examples, which can also be designed in relation to specific company needs if required.
